Source: The Gazette, Cedar Rapids, IowaSept.self storage 04--A judicial panel has recommended that Iowa City attorney Jeff McGinness, who is a member of the Iowa City school board, lose his law license for six months because of professional misconduct.The Iowa Supreme Court Grievance Commission last month found that McGinness, who also is a former star wrestler at Iowa City High School and the University of Iowa, falsified documents in a civil case in 2012 and, when confronted, lied about it to the opposing attorney and a judge.McGinness eventually admitted to three violations of the Iowa Rules of Professional Conduct, which detail lawyers' professional and ethical responsibilities. Violating the rules can result in discipline.The case will be submitted to the Iowa Supreme Court, which can impose a sanction different from what has been recommended, said Steve Davis, spokesman for the Iowa Judicial branch. The matter has not yet been scheduled.McGinness also could appeal the commission's report, he said.The situation may not affect McGinness' position on the school board. There does not appear to be any provision in state law or school district policies that would prevent him from continuing to serve on the board. He is about to finish his second year of a four-year term.McGinness did not immediately return phone and email messages Tuesday and Wednesday.According to a complaint filed with the Grievance Commission in January and the commission's report filed in August, McGinness falsified a document as part of the discovery process in a civil case last year. He worked at the Simmons Perrine Moyer Bergman law firm at the time but has since started his own practice.Shortly before a deposition in June 2012, the opposing attorney, David Nelmark, said he had not received answers to a request he'd made that March. McGinness said he had served the documents in March and provided copies that included a certificate of service signed by his assistant.In looking at the electronic data imbedded in the documents, Nelmark discovered they were created in June. He also hired a handwriting expert who determined the certificate of service emailed by McGinness in June was a copy of one from earlier in March.McGinness denied they were fake to Nelmark and to a judge in an August 2012 hearing. District Court Judge Douglas Staskal, however, found beyond a reasonable doubt that the allegations were true.In September, McGinness sent a letter to the Attorney Disciplinary Board saying Staskal's findings were correct, writing that he did so "with extreme disappointment in myself as an attorney, person and father."A complaint was filed this past January alleging three violations of the Iowa Rul迷你倉s of Professional Conduct. As the process played out this year, McGinness again admitted to falsifying and misrepresenting the documents and lying about doing so, according to the Grievance Commission.The commission determined he did so to delay his client's deposition "to gain a litigation advantage." In recommending the six-month suspension of McGinness' law license, the commission's Jessica Bear called the violations "very serious.""Violations of this nature reflect poorly on the Respondent (McGinness), as well as on the legal profession as a whole," she wrote in the report on the matter.Paul Gowder, a University of Iowa law professor who does research on ethics, said the courts depend on lawyers telling the truth to ensure a fair process. But, he said, it's not unheard for a lawyer to miss a filing deadline and instead of going to court to fix it, the person tries to cover it up."It's serious," he said of McGinness' actions. "And it's not particularly rare and it's not particularly malicious. We're not talking about stealing money from a client."One of the mitigating circumstances the Grievance Commission considered was McGinness' service to the community, which includes being on the school board and other civic organizations and coaching youth sports.While the commission commended him for that work, it also suggested it played a role in his misconduct. Bear wrote that all the commitments created a situation in which McGinness was overextended.Representatives from multiple state agencies and the Iowa Association of School Boards said Wednesday they knew of no laws or ethics guidelines that would prevent McGinness from continuing to serve on the school board.The Iowa City school board has a code of conduct that says board members are to act ethically, businesslike and lawfully, "including proper use of authority and appropriate decorum when acting as Board members." We sacrifice it when we get busy, we even sometimes brag about how little we get, but missing sleep or getting poor-quality sleep is a health hazard, a risk factor for accidents of all kinds and a drain on efficiency.We're sleepless in Seattle and, according to a new poll, around the world. Modern life is taking a toll on sleep that requires active effort to repair, starting with awareness.The poll I read was released Wednesday by the National Sleep Foundation, which works to improve sleep and safety, primarily through public education. The foundation surveyed the bedroom habits of people between the ages of 25 and 55 in six countries: the United States, Canada, Mexico, the United Kingdom, Germany and Japan.It caught my eye because I was sleepy. But I was also interested because of the push in Washington state this year to reduce incidences of impaired driving. Much of the emphasis has been on people who drive under the influence, but driving while drowsy is also a significant cause of traffic collisions.I also thought about the safety of all the children who've just started walking back and forth to school again.It can be hard to get a good night's sleep during the school year. But without it, students' grades suffer, parents' work suffers and moods suffer for everyone.Sleep deficits may help coffee sales, but that's about it. Sleep loss contributes to depression, forgetfulness, accidents. Chronic sleeplessness is a factor in heart disease, diabetes and other hemini storagelth problems.Don't fight your body clock. The Seahawks are catching on. The football team has been holding morning practices so that players won't doze when they open their season with an East Coast game Sunday.The rest of us are missing the ball. According to the poll, j ust over half the people in the countries surveyed said they don't get a good night's sleep every night, and most said they sleep in on weekends in an attempt to make up for lost rest.The world is becoming one in being more rushed, having less time for family, reflection, or even something so basic as sleep. And people everywhere seem to want to zone out for just a bit in compensation for all the day's intensity.The poll discovered one big common bedtime ritual: Most people around the world (66 percent to 80 percent) watch TV in the hour before bed. That's not helpful.Among the foundation's tips for a good night's sleep are several you've heard before:Exercise regularly, go to sleep and wake up at the same time every day, use the bedroom only for sleep (there's at least one exception I can think of, but not work, computing or television) and save your worries for daytime.We ignore the advice, maybe because we think we can handle the deficits. Several studies have shown that isn't true. Source: San Bernardino County Sun, Calif.迷你倉新蒲崗Sept. 04--HINKLEY -- Pacific Gas and Electric Co. is proposing changes to a whole house replacement water system here in the wake of a first-of-its-kind proposed drinking water standard for chromium-6.Last year PG&E voluntarily introduced what it calls "an unprecedented program" that offers a sophisticated treatment system to remove chromium-6 from the residential wells of town residents.Residents could participate if their homes were within a mile of the chromium-6 plume boundary and their wells had any detection of chromium-6.On Aug. 23, the state of California issued a proposed chromium-6 drinking water standard of 10 parts per billion.A lengthy public comment period has begun and it might be a year or more until that standard is adopted -- one which would be the first of its kind in the nation."PG&E believes future eligibility for the program should be modified pending the final drinking water standard," wrote Sheryl Bilbrey, PG&E's director of chromium remediation.The letter, directed to Patty Kouyoumdjian, executive officer of the Lahontan water control board, seeks to eliminate the one-mile buffer zone and require that future program participants live within the plume boundary and that their domestic well has a chromium-6 detection level above 3.1 parts per billion."Residents who currently are eligible for the program will remain i迷你倉出租 the program with no changes," she wrote Tuesday.PG&E's program guarantees that the level of chromium-6 in its replacement water is more than 800 times lower than the standards currently applied to other California residents.During the 1950s and early 1960s, PG&E used chromium-6 to protect the metal of its cooling towers used to keep natural gas flowing at its Hinkley compressor station.Periodically the cooling tower liquids, including chromium-6, were dumped into unlined ponds, where chromium-6 seeped through the dirt and entered the large underground water supply beneath Hinkley.The resulting plume is believed to be more than seven miles long and two miles wide."PG&E is committed to cleaning up the chromium-6 caused by its historical operations," Bilbrey wrote.Top executives with the Lahontan Regional Quality Control Board Water could not be reached for comment Tuesday."This is way too premature," said Lester White, a longtime Hinkley resident who is head of a community committee that represents residents at meetings with PG&E and the water board."They are trying to duck their responsibilities," said Daron Banks, who serves on the Community Advisory Commission, along with White.Copyright: ___ (c)2013 the San Bernardino County Sun (San Bernardino, Calif.) A man gets out and walks to one side of the Vietnam veterans memorial.A second car pulls up. A man gets out and walks to the other side of the memorial.Slowly, the men make their way toward one another. They exchange greetings, sometimes a handshake."You see them out there for an hour or so, and you realize, they're both Vietnam vets," Schenck said.Those encounters -- brothers in arms catching up decades after the war ended -- sparked an idea thatwill become a reality at the York Fair this year.The Vietnam Veterans Experience will be on exhibit under a tent set up near the memorial for the duration of the fair, which runs from Sept. 6-15.Schenck said there are several goals for the exhibit, including educating the public about the war, educating veterans about the benefits they're owed, and honoring veterans for their service.This year marks the 40th anniversary of the withdrawal of combat troops from Vietnam, Schenck said. That's another reason to have the exhibit at the fair this year.He said the exhibit will feature a map for veterans to mark where in Vietnam they served, and also allow veterans' connections -- like those he's seen at the memorial -- happen on a larger scale.---For months, a group of Vietnam veterans met weekly to plan the Vietnam Veterans Experience. Their gatherings solidified the need for the exhibit at the fair, Schenck said.The men often spend time exchanging stories of what they did during the war. Some of the men, Schenck said, don't talk about the war outside of those meetings. He knows there are other Vietnam veterans who have no outlet to share their stories.For many, the memory ofan unpleasant homecoming is something they've carried with them for decades."There was a stigma attached to being a Vietnam veteran," Schenck said. "If you were a returning Vietnam veteran in the 70s, it was likely you hid the fact that you served. If you were looking for a job and an employer knew you were a Vietnam veteran, you probably didn't get a job."Some veterans tucked the stories of Vietnam and their service away after they got home."A lot of Vietnam veterans are people in the community, but we don't know who they are because they never told anybody," Schenck said.Schenck hopes the exhibit will reach those veterans, allowing them to engage with other individual veterans or veterans organizations, likethe VFW.Jim Bean, of West Manchester, served from 1966 to 1968 in the Marines. He enlisted and volunteered to go to Vietnam. He said his father served in World War II, and, "I felt it was my turn to serve our country."Bean said most veterans of the Vietnam War didn't see combat. He was among those who did. He knows other veterans who have a hard time talking about what they saw and what they did, but he has been able to talk about his experiences, and the blood and loss of life he saw."Maybe that's my salvation," he said. "I talk about what I did."And in the VFW and the American Legion, he said, he's found a network where he can share his stories without being judged."I don't think you can go throughany war and not have it have an effect on you," Bean said. "A lot of people don't talk about their service. But if they got the opportunity to talk to another veteran, especially one who was in the same branch or same area as they were, I think they would come out of that shell."---Although there is camaraderie among living Vietnam Veterans, the legacy of those who died have died, especially those who were killed during the war, is key for many veterans.Don Nicklow, who served in Vietnam in 1967 and 1968, visits the Vietnam memorial on the fairgrounds every day."I take my daughter to work in th迷你倉 mornings and I'll stop by and look at the monument," he said. "Some days, I'll pull into the shade there and look around."Nicklow was on the committee that raised funds for the memorial, which was dedicated in 2009.He said sometimes he sits in his car, and turns on some music for the guys who didn't make it home."I had a couple real close friends who are on that monument," Nicklow said. "I think of the times we had...I go over and think about what these guys could be doing today."Nicklow said it's important to remember those who sacrificed and served. The Vietnam Veterans Experience can help visitors do that."It's something that's got to be taught to let people know how things changed during different times of different wars," he said.---More than 1,200 veterans made an appointment with the York County Department of Veterans Affairs from 2012 to 2013 to learn about the benefits they earned.As a result, the office filed $5 million in successful claims for veterans, according to Philip Palandro, director of the York County Department of Veterans Affairs.Palandro said veterans of all wars can pick up information on benefits from the Vietnam exhibit. Sometimes, he said, veterans aren't aware of what they can get. And sometimes, benefits extend to a veterans spouse and/or children."These (veterans) are so important for what they did and ... it's our job to be available and provide information on the benefits they've earned through their service," Palandro said.---Barre Shepp , of West Manchester Township, served in the Navy from 1960 to 1981 before he retired.He said it was his privilege to serve, despite some of the anti-war pushback in the 1960s.Shepp was a meteorologist and a flight forecaster."I always found myself with some sort of exotic duty, and I enjoyed it," he said. He learned about how to detect where submarines would lie in the water, and he worked in aviation.After he retired from the Navy, Shepp served as the director of the York County Department of Veterans Affairs. He retired from that position in 2007.Shepp said many Vietnam veterans came home with post-traumatic stress disorder and other issues."We didn't realize before, the Vietnam veterans, a great number of these men and women were affected by these diseases and they didn't know what the hell it was," Shepp said. "Not we're starting to get a handle on it and starting to deal with it."Although PTSD was a problem for many Vietnam veterans, and continues to be a problem for some, not all veterans of the Vietnam War were damaged goods, Schenck said.The Vietnam veterans who have been planning the exhibit at the York Fair "want to communicate that despite what people think about Vietnam veterans, the majority of them came home, led productive lives," Schenck said.More information for veteransThe York County Department of Veterans Affairs will have information available to veterans of all wars at a table inside the Vietnam Veterans Experience Tent -- which will be set up near the Vietnam memorial on the fairgrounds during the fair.District 21 of the Veterans of Foreign Wars will also have information available at the fair, at booths 64 and 65 inside Memorial Hall West.John Chiodi, service officer for the Department of Pennsylvania Veterans of Foreign Wars, will be available from noon to 6 p.m. on Sept. 6 and Sept. 12. It's about special teams. Every backup player on this team, and we've said it since Day 1, there's three ways for them to make this football team. Special teams, special teams, special teams. It's how can they contribute from a special-teams standpoint. If you're going to be the fourth or fifth receiver, and right now that's Damaris [Johnson] and Jeff, the value that they have is what they mean to [special-teams coordinator Dave Fipp]."Same thing with linebackers. Why did we keep three backup inside linebackers as opposed to one backup outside linebacker? It's how those three players contribute on special teams. That's why we made the move to get [linebacker Najee] Goode from Tampa Bay. Same thing. President Xi Jinping says Beijing has deliberately engineered the current slowdown in the mainland’s economic growth in order to push ahead with structural reform.儲存倉It’s always a good idea to try to make a virtue out of a necessity.But in this case, no one is fooled. Xi didn’t choose this slowdown. It was forced on him by past government policy decisions.At the end of 2008, with China’s biggest export markets sliding into financial chaos, policymakers in Beijing opted to pursue high growth at all costs.In response to government orders, the country’s banks opened their lending taps. Companies, especially big state sector corporations, needed no other encouragement, and borrowed with a will to fund an investment boom.In 2009, infrastructure investment leapt more than 40 per cent. The following year investment in the property sector jumped almost 35 per cent. And in 2011 manufacturing investment surged over 30 per cent.This credit-fuelled investment binge succeeded in keeping growth up at near double-digit rates. But the inescapable consequence was a sharp build-up in leverage within China’s economy as corporate balance sheets ballooned.According to Helen Qiao, the chief greater China economist at investment bank Morgan Stanley, between 2008 and 2012 total liabilities in the Chinese economy shot up from 150 per cent of gross domestic product to 220 per cent (see the first chart).To put that degree of leverage into perspective, it’s not far off the peak level of non-financial sector debt the United States hit in 2007, immediately before the financial crisis.Among the most eager to borrow and invest were big state companies in heavy industrial sectors. As a result, today, China’s miners, steel mills, aluminium smelters, and petrochemical companie迷你倉價錢 boast some of the highest leverage ratios in the country. And thanks to all that investment, they also suffer from the greatest overcapacity.Unfortunately, excess capacity erodes pricing power, which means all that investment has failed to produce an increase in productivity growth.Different analyses come up with different figures, but broadly they tend to agree. Over the past five years, China’s productivity growth has slumped by half, falling to modest single digit rates (see the second chart).Over the same period, however, a combination of currency appreciation and generous wage increases has pushed China’s unit labour costs sharply higher. According to a study by Lombard Street Research, China’s unit labour costs have now risen by some 50 per cent from pre-crisis levels. In contrast, Korea’s have fallen 20 per cent.This is an ominous combination. High leverage, a shrinking bang for every additional investment buck, and declining competitiveness all point to a steep and protracted slowdown for China’s economy – whether Xi and other policymakers like it or not.It’s true that they could attempt to keep growth high by sanctioning even greater leverage to fund yet more investment.But with returns diminishing rapidly, that approach would soon trigger a devastating financial crisis.As it is, Xi and his cohorts are going to be faced with the daunting challenge of steering China’s deleveraging.   帶薪年休假是法律賦予勞動者的一項基本休息權。隨著人們物質生活水平的提高,迷你倉出租越來越多的人都期待著在休假期間,能夠與家人一同外出,放鬆身心,可黃金周景點擁堵、高速爆堵等問題,讓勞動者們不得不將充分享受假期的目光集中在了年休假上。某中級人民法院發佈的一項調研卻顯示,在該院過去一年所審理的3467件案件中,有45.2%包括了因未能享受年休假而要求補償的訴求。那麼,到底是什麼讓勞動者享受法定年休假變得如此不容易?  以待崗用工規避年休假條件  2007年4月,邢某到某科技公司任職,直到2010年5月與公司解除合同,邢某先後簽訂了四份勞動合同,且合同期限都不滿一年。這些合同中約定,正常工作期間支付正常月工資,在生產任務不足的待工期間支付月生活費。  在邢某與科技公司的勞動爭議糾紛中,邢某向公司主張了自己的年休假補償。不過,對此訴求,科技公司卻提出,公司的主要業務是提供音像資料的編目服務,邢某所簽訂的勞動合同是以完成一定工作任務為期限的勞動合同。而且,邢某每年都有待崗時間,不存在連續工作滿12個月的情形,不應當享受帶薪年休假。  但邢某認為,他在科技公司連續工作滿三年,並不存在間斷的情形,且雙方所簽訂的也並不是以完成一定工作任務為期限的合同,自己依法應當享受帶薪年休假。在公司沒有安排休假的情況下,就應當支付未休年休假工資。案件審理過程中,邢某提供了其在公司連續工作的證明。  法院最終認定,根據邢某提交的證據,其與科技公司之間的勞動關係已經連續存在一年以上,滿足了勞動者享受帶薪年休假的前提條件,在公司沒有依法安排邢某帶薪年休假的情況下,應當支付未休年休假工資。  ■ 法官提示  待崗期間不能折抵假期  法官解釋說,待崗是因為生產任務不足、生產條件不具備,勞動者等待用人單位安排工作的狀態;待崗期間,勞動者無需向用人單位提供勞動,用人單位則只向勞動者支付生活費。  但在用工實踐中,部分單位卻將待崗作為了規避自身責任的一個“砝碼”。例如,一些用人單位利用待崗,人為地中斷勞動者的連續工作年限,或者乾脆以待崗期限折抵休假期限,從而達到規避安排帶薪年休假義務的目的;也有部分單位,在與勞動者簽訂勞動合同時“不滿簽”,即合同的簽約期限均不簽足一年,製造勞動者並未連續工作的假象。而事實上,帶薪年休假期間,勞動者享受的是正常的工資收入;而待崗期間,勞動者只能享受基本生活費,兩者之間截然不同。  不過,法官表示,只要勞動者能夠提供證據,確認其連續工作時間,法院一般都會連續計算勞動者的工作年限,為勞動者爭取最大的補償利益。即便是在存在待崗的情況下,只要符合《職工帶薪年休假條例》規定的休假條件,仍然是可以主張享受帶薪年休假權利的。正因如此,勞動者在工作中,要努力收集有關連續工作時間的相關證據,以便在訴訟舉證過程中贏得主動。  以無假承諾限制休假權利  張某是一名司機,2011年3月5日到某公司工作,雙方簽訂了期限為兩年的勞動合同。可在這份勞動合同之外,公司還要求張某簽訂了一份承諾書,這份承諾書中就規定了張某“無年假”。  後來,張某與公司發生勞動爭議,將公司告上了法庭。其中,張某主張,自己在2012年度沒有享受年休假,要求單位支付未休年休假工資。可對於這項訴訟請求,公司迷你倉不以為然,一是認為張某已經簽訂了承諾書,認可其“無年假”的待遇;二是張某作為司機,其負責駕駛的車輛每周都有一天限行,車輛限行時間就應該可以折抵年休假待遇。  但是,公司的理由並未獲得法院的支持。法院根據雙方勞動合同的內容,判斷張某的工作內容除了開車以外,還要負責車輛維修、協助經理工作等,車輛限行期間雖然不能出車,但並不代表他可以不工作而享受休假待遇。因此,公司提出的車輛限行時間可以折抵年休假待遇的主張不能成立。至於承諾書,法院指出,帶薪年休假是勞動者的法定權利,雙方之間關於勞動者無休假的約定根本就是無效約定。據此,法院支持了張某的訴求。  ■ 法官提示  承諾放棄年休假也無效  法官解釋說,帶薪年休假是勞動者享受的法定休假權利之一,且法律對於勞動者的帶薪年休假已經作出了最低標準的規定,任何用人單位都不能通過約定的方式降低勞動者依法應當享受的年休假待遇,否則這種約定就會因為違法而被認定為無效。此外,還有些勞動合同中約定了高于法定天數的年休假天數,但同時約定“一年內沒休完作廢”。對於這種規定,如果是高于法定天數的部分,一年內未休完的,即可根據雙方的約定作廢掉,但是法律所規定的最基本的年休假天數,法院仍然會予以保障。  對此,法官建議,勞動者應當明確自己所享受的法定權利,在簽訂勞動合同以及其他附屬協議時,要保持一定的警覺性。一旦用人單位要求勞動者簽署的文件中有限制、剝奪法定權利的相關內容,勞動者可以積極行使法律手段維護自身合法權益,或者明確予以拒絕或申請司法機關認定無效。  以旅遊福利混淆休假事實  陸某在一家外企公司工作了將近三年,後解除勞動合同。在訴訟中,陸某主張,他在2010年度沒有享受帶薪年休假,要求公司支付未休年休假工資。  可公司認為,陸某雖然沒有單獨休假,但單位在5月8日至15日期間安排他外出旅遊,應當視為其已經享受了帶薪年休假。為了證明,公司還提交了當月的考勤記錄、旅遊照片、火車票等證據。  對於參加單位安排的旅遊的事實,陸某並不否認,可他不認為旅遊福利就是年休假待遇。  對此,法院則認為,外出旅遊是單位為員工安排的福利待遇,並不能視為勞動者享受了年休假。而且,用人單位並沒有提前向勞動者說明,旅遊時間是要折抵年休假天數的,因此公司的主張不能成立。  ■ 法官提示  旅遊作福利不能抵年休假  法律規定勞動者所享有的休息權,就是勞動者在勞動中經過一定的體力和腦力消耗以後,依法享有獲得恢複體力、腦力以及用于娛樂和自己支配的必要時間的權利。也就是說,勞動者的休假權是為了保障勞動者的身體健康和休息權,以提高工作效率而設立。而與此同時,很多用人單位為了激勵員工勞動、提高員工待遇,還為員工專門安排有定期的外出旅遊、報銷旅遊費用等福利待遇。這種福利待遇是用人單位高于法定標準之外給勞動者的權益,可從性質上講,旅遊福利畢竟不是純粹的自由支配休息、放鬆時間,因此用人單位不能以福利待遇之名來剝奪勞動者的法定休假權利。  法官也建議說,用人單位應當制定詳細的休假制度。如果用人單位有相應的以福利待遇折抵年休假天數的規定,則應當提前向勞動者告知公示,以便勞動者在享受單位福利待遇或是享受法定年休假待遇之間作出明確選擇。標簽:年休 邢某 張某 勞動者 待崗儲存倉
