Source: Herald-Times, Bloomington, Ind.mini storageJan. 05--Several factors could affect the fate of House Joint Resolution 6, Indiana's proposed constitutional ban on same-sex marriage, in the state legislative session that begins Monday.Nationally, views about whether same-sex marriage should be allowed appear to have changed in the three years since the Indiana General Assembly voted in favor of the resolution, as signified by recent U.S. Supreme Court decisions and 13 states taking steps to legalize same-sex unions. Still, there are 28 states that ban same-sex marriage in some form through constitutional amendments, though several of those are being challenged in the wake of the recent judicial rulings. Four states, including Indiana, have statutes banning same-sex marriage.The main argument of those supporting the resolution is that the public should decide by voting in a referendum in November. Those fighting the ban say it shouldn't pass at all because it's wrong to limit people's rights and a ban would put Indiana at an economic disadvantage compared with states that don't have a ban in place.Either way, the issue is expected to be highly debated during the coming session of the Indiana General Assembly.SupportPro-amendment forces have maintained for years that adding an amendment to the Indiana Constitution would give added protection to the state statute, which has been in place since 1997.Should Indiana adopt the amendment, it would follow 25 other states that added amendments on top of existing state laws that define marriage as being between a man and a woman.The amendment proposal passed the General Assembly in 2011, but in Indiana, two separately elected Legislatures must approve possible amendments before voters make the final decision. The 2013 Legislature waited for a ruling by the Supreme Court, and now, the 2014 Legislature will have to approve the amendment in order to keep it alive.Micah Clark has supported an amendment for 12 years. Clark, who is the director of the American Family Association of Indiana, has testified before state legislative committees in support of an amendment and could again this year. His hope is that 2014 is the year that an amendment finally makes it from the hands of legislators to the hands of voters."I would rather have the people vote this down than have a judge or a court change the laws to our state," he said. "I can live with it if the people vote it down."An amendment got to this same point in 2005, but a Democratic-controlled Legislature blocked it from moving forward the following year.A Republican majority easily passed the bill in 2011, but court decisions in the past two years have overturned amendments in other states. How those decisions will affect debates in Indiana this year is unknown.Proponents of the amendment first emphasized pro-marriage arguments; this time around, arguments center mostly on giving voters the chance to decide.Still, the ultimate hope for Clark and other supporters is that voters will approve an amendment, making Indiana the first state to add a constitutional amendment banning gay marriage since North Carolina voters approved one in 2012.Opponents of the amendment include large employers, among them Eli Lilly and Indiana University. Some businesses have warned that such an amendment would have a negative economic impact.Indiana already has a statute that bans gay marriage, and Clark said that adding it as an amendment would complicate a judge's ability to overturn the ban, but it would not change anyone's rights. Likewise, he said businesses have not been affected in other states with similar amendments.The amendment sets a public policy standard, and removing any law could lead to other forms of marriage including polygamy, Clark said."Marriage is a standard, and whenever you have a standard, some people may not meet that standard," he said. "If that's unfair, it's unfair."Other cultures and states have defined marriage for years, as has Indiana; an amendment would just reinforce that definition, he said."Diverse cultures for thousands of years have recognized that marriage is between a man and a woman; children need a mom and a dad," Clark said. "Whatever two women may be, they're not a dad."OppositionRecent polls have given hope to opponents of the marriage amendment to the Indiana Constitution.A WISH-TV/Ball State Hoosier Survey found that about 58 percent of those polled were opposed to the amendment, though split on the question of gay marriage itself.Two Bellwether research polls, conducted for Freedom Indiana -- a nonprofit group that opposes the amendment -- in September and Howey Politics in April 2013, found that about 46 percent of those polled would vote no on the amendment. The Bellwether/Freedom Indiana poll also found that more than 60 percent of respondents said they have a friend or family member who is gay.Jennifer Wagner, spokeswoman for Freedom Indiana, said that it's that last number that makes amendment opponents most hopeful for the future of gay rights in the state."It's really hard to look at your uncle Joe or your sister or brother and say, 'You should have different rights,'" Wagner said.The ultimate hope is that the amendment dies for a second time in the Legislature, as it did in 2006.Freedom Indiana began in Augus儲存 as a bipartisan campaign against the amendment. What exactly this means in a real sense for businesses and employee benefits is unclear."The second sentence is really the problem, and I think you'll see a lot of the debate will center around it," Wagner said.Lawmakers could scrap the entire amendment and start over with a new amendment without the second sentence. However, there's another possibility --lawmakers could try to pass the amendment by removing the sentence. There's no precedent in Indiana for a case like that, and whether or not it would start the amendment process over is unknown."Anything could happen," Wagner said. "We're going to keep up the pressure. If we have to go to November, we're ready for that too."State legislatorsFour of the area's six state legislators already have voted once on HJR-6 and will return this year to vote again.Rep. Matt Pierce, D-Bloomington, was the only local state lawmaker who voted "no" the first time the resolution passed the Indiana General Assembly in 2011, and his vote isn't going to change."Well, I think clearly public opinion has shifted and continues to shift quickly away from the amendment," Pierce said.Other House lawmakers who represent a portion of Monroe County -- Reps. Bob Heaton, R-Terre Haute, Eric Koch, R-Bedford, and Matt Ubelhor, R-Bloomfield -- voted in favor of it and were all listed as co-authors of the resolution. None of the three responded to requests to be interviewed.Rep. Peggy Mayfield, R-Mooresville, wasn't in office in 2011. She couldn't be reached for comment.In the Senate, Sen. Brent Steele, R-Bedford, joined 39 colleagues voting for the resolution. Sen. Mark Stoops, D-Bloomington, wasn't in office at the time, but has said he will "absolutely" vote against it this year.Steele hasn't officially said whether his vote will stay the same, but he has commented that the voters should decide."HJR-6 is an issue that is either going to be decided by judges or by our voters," Steele said. "People have the right to make that decision ... and I think they should."The resolution easily passed through both chambers in 2011, with a 40-10 vote in the Senate and 70-26 vote in the House.Stoops and Pierce agree that the Republican argument has shifted toward letting the public decide, but they said it shouldn't have to get that far."I don't think there's any reason to. I think it's a constitutionally protected right," Stoops said. "If in the '50s and '60s, if Indiana voted to support Jim Crow laws, would that have made it right? And I don't believe it does."There's also the possibility of changing the wording in the resolution, specifically the second part, which is described as too vague and could also strip away benefits from unmarried heterosexual couples.Indiana Attorney General Greg Zoeller hasn't issued a definite opinion one way or the other on whether altering the wording would keep the referendum off ballots in the fall."There hasn't been a case directly on point," he said. "So had there been a question asked and answered, I'd be able to point to something specifically for people to refer to. The fact that it has not been fully addressed leaves it open to supposition as to what a federal court might do or what a state court might do."Stoops predicted that should the resolution pass through and be approved by voters, it would be dealt with in the court system and overturned within a few years."I think it is a right. We all have friends or relatives or co-workers that are gay. Are we saying that we're somehow better than them, that we have more rights than them?" Stoops said. "That will be the question that I will be asking legislators ... Yet lighting experts say consumers should embrace the change because they will save money in the long run.With the start of the new year on Wednesday, it became illegal to manufacture or import 60- and 40-watt incandescent bulbs because of the Energy Independence and Security Act of 2007."Basically, what you are going to lose is the word incandescent, but you don't lose anything in the actual light bulb," said Dennis Cooper of Garbes Lighting and Home Accessories. "Incandescent is what we have had for 200 years, and it was a great thing because it was the only thing we had."The Jan. 1 phaseout of old-style 40- and 60-watt bulbs is the third step in the change to more efficient forms of lighting. The first step, in 2012, targeted 100-watt bulbs and was followed in 2013 by the elimination of traditional 75-watt bulbs."An enormous amount of energy is wasted by incandescent bulbs," Cooper said. "And all of the problems we have with the environment are mainly because we have wasted so much energy."The new lighting standards "have led to more lighting innovation over the past five years than we saw during the 100-plus years since Edison invented the light bulb," Noah Horowitz, director of the National Resources Defense Council's Center for Energy Efficiency, wrote in his blog.Cooper noted that now there are essentially three choices: compact fluorescent light bulbs, LED bulbs and halogen bulbs. But he has his favorite lighting choice and called LED the "wave of the future" due to the enormous amount of energy saved."If every household in America changed one light bulb from incandescent to fluorescent, we would save enough energy every day to power 30,000 new homes," Cooper said. "Can you imagine what would happen if everyone changed all of them?"Changing from an incandescent bulb to an LED bulb results in an 80 percent savings."Halogen is the step in between because some people are not ready to spend up to $30 for the LED, even if it lasts for many more years," Cooper said.Cooper has become skilled at explaining the incandescent phaseout to customers and the benefits of the bulb alternatives.
